Acceptance of Terms
By accessing or using the Maule Law website and platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service constitutes your acceptance of any modified Terms.
Description of Services
Maule Law provides a web-based platform for tax and estate planning legal services, including but not limited to: IRS audit representation, tax preparation and filing, tax court representation, estate planning, probate administration, asset protection, special needs trust planning, and Medicaid planning. The platform includes AI-assisted case analysis, document generation, secure client portals, deadline tracking, and communication tools. All legal services are provided by a licensed attorney and are subject to the terms of a separate engagement letter.
No Attorney-Client Relationship from Website Use
Browsing this website, submitting a contact form, or creating a user account does not establish an attorney-client relationship. An attorney-client relationship with Maule Law is formed only upon the execution of a written engagement letter signed by both you and the attorney at Maule Law. Information provided through the website prior to the formation of an attorney-client relationship is not protected by attorney-client privilege and should not include sensitive or confidential details about your legal matters.
User Accounts
To access certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information.
- Maintain the security and confidentiality of your login credentials.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
Subscription Terms and Payments
Certain services are offered on a subscription basis. By subscribing, you agree to the following:
- Billing: Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. All fees are in U.S. dollars.
- Payment Processing: Payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for the applicable fees.
- Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
- Price Changes: We may change subscription fees upon 30 days' written notice. Continued use after a price change constitutes acceptance of the new fees.
- Refunds: Subscription fees are generally non-refundable. If you cancel your subscription, you will retain access to the Service through the end of your current billing period. Refund requests for one-time consultation fees will be considered on a case-by-case basis within 14 days of payment.
AI-Assisted Features
Our platform uses artificial intelligence to assist with case analysis, document drafting, and other functions. You acknowledge and agree that AI-generated content is intended as a tool to support, not replace, professional legal judgment. All AI-generated documents and assessments should be reviewed by a qualified attorney before reliance. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose. Please see our Legal Disclaimer for additional details.
Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the property of Maule Law or its licensors and are protected by United States and international copyright, trademark, patent, and trade secret laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without our prior written consent. Documents generated for your legal matters through the platform are owned by you, subject to our retention rights under applicable professional responsibility rules.
Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Submit false, misleading, or fraudulent information.
- Attempt to gain unauthorized access to the Service, other accounts, or systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to transmit malicious software or code.
- Scrape, crawl, or use automated means to access the Service without our written permission.
- Use the Service for any purpose that is illegal or prohibited by these Terms.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAMES L. MAULE, PLLC (D/B/A MAULE LAW) AND ITS ATTORNEY, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THIS LIMITATION DOES NOT APPLY TO LIABILITY ARISING FROM PROFESSIONAL MALPRACTICE, WHICH IS GOVERNED BY APPLICABLE STATE LAW AND PROFESSIONAL RESPONSIBILITY RULES.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. THIS DISCLAIMER DOES NOT AFFECT THE STANDARD OF CARE OWED TO YOU AS A CLIENT UNDER A SIGNED ENGAGEMENT LETTER.
Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be resolved as follows:
- Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to contact us at james.maule@mauletax.com and attempt to resolve the dispute informally for at least 30 days.
- Mediation: If the dispute cannot be resolved informally, the parties agree to participate in non-binding mediation before a mutually agreed-upon mediator in Michigan.
- Litigation: If mediation is unsuccessful, either party may pursue claims in the state or federal courts located in Michigan. Disputes related to attorney malpractice are governed by applicable Michigan law and State Bar procedures.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in the State of Michigan for the resolution of any disputes arising under these Terms.
Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us. Termination of your platform account does not terminate any existing attorney-client relationship, which is governed by the terms of your engagement letter and applicable professional responsibility rules.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
